1. Agreement to Terms
By accessing or using the Covered platform ("Service"), operated by Callixo Pty Ltd ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.
Covered is a childcare management system designed for Australian early childhood education services. The Service is intended for use by authorised personnel of registered childcare organisations only.
2. Eligibility
- You must be at least 18 years old to create an account.
- You must be an authorised representative of an Australian childcare service or related organisation.
- You are responsible for maintaining the confidentiality of your account credentials.
3. Service Description
Covered provides AI-assisted compliance management, educator credential tracking, child enrolment management, notification services, and reporting tools for Australian early childhood education centres. The Service includes:
- Compliance tracking aligned with the National Quality Framework (NQF) and ACECQA standards
- Educator qualification and Working With Vulnerable People (WWVP) check management
- AI-powered compliance intelligence (advisory, not directive)
- Document management and processing
- Notification and communication tools
- Reporting and data export capabilities
4. AI Features Disclaimer
Important:Covered's AI-powered features provide suggestions and analysis to assist decision-making. They do not constitute legal, regulatory, or professional advice. You remain solely responsible for compliance decisions, regulatory obligations, and the accuracy of data entered into the system. Always verify AI-generated recommendations with qualified professionals and official regulatory guidance.
5. Subscription & Billing
- Covered is offered on a per-service, per-month subscription basis.
- Pricing tiers: Starter ($99/month), Professional ($149/month), Enterprise ($199/month).
- Subscriptions renew automatically unless cancelled before the renewal date.
- Payments are processed securely via Stripe. We do not store credit card details.
- Refunds are available within 14 days of initial subscription only, on a pro-rata basis.
6. Data Ownership & Privacy
- Your data belongs to you. We are custodians, not owners, of the data you store in Covered.
- You may export your data at any time in standard formats (CSV, JSON).
- We process your data in accordance with our Privacy Policy and the Australian Privacy Act 1988.
- All data is stored in Australia (Sydney region). No sensitive data leaves Australian jurisdiction except via PII-redacted external API calls.
- Upon subscription cancellation, your data is retained for 90 days for reactivation, then archived per our data retention policy.
7. Acceptable Use
You agree not to:
- Share your account credentials with unauthorised individuals
- Use the Service for any purpose other than childcare management
- Attempt to access data belonging to other organisations
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use automated tools to scrape or extract data from the Service
- Upload malicious files, code, or content
8. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by third-party infrastructure providers, internet outages, or force majeure events.
9. Limitation of Liability
To the maximum extent permitted by Australian law, Callixo Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
10. Termination
- You may cancel your subscription at any time via the billing settings.
- We may suspend or terminate your account for violation of these Terms, with notice.
- Upon termination, data export is available for 90 days.
11. Governing Law
These Terms are governed by the laws of Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email and in-app notification at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
